Does AFX meet the Buy American provision requirements?

Yes, AFX offers products meeting the Buy American provision within ARRA based on the following;

  • Final assembly occurs in the U.S. and a substantial transformation also occurs in the U.S.
  • Ballasts are considered a component and not factored into the analysis regarding Buy American within the ARRA provision.

Background

The Buy American Act (BAA) dates back to 1933 and has a similar intent as the American Recovery and Reinvestment Act (ARRA) which became effective in February 2009. Both are designed to stimulate the American economy by creating new jobs and maintaining existing ones through economic activity and long term growth.

The Buy American Act (BAA):

Applies to most federal agencies where the funding for projects is not derived from stimulus funds in the ARRA legislation. The Buy American Act stipulates the U.S. Government support U.S. made products in their procurement process by giving preference to U.S made.

The Buy American provision within the ARRA:

Applies to most federal agencies where the funding for projects is derived from stimulus funds in the ARRA legislation. Stimulus funds cannot be allocated unless the public building or work is located in the U.S. and all of the iron, steel or other manufactured goods used as construction material in the project are manufactured or produced in the U.S. For more specific information on the BAA provision, refer to section 1605 (page 189) of the ARRA document at www.energy.gov/recovery/index.htm
